Is gratuity calculated on basic pay or total salary?
Basic pay. Housing, transport and other allowances are excluded, which is why a package that is mostly allowance produces a much smaller gratuity than the total salary suggests.
What if I resign rather than being terminated?
Under the current federal labour law the accrual rate is the same. What can change the figure is continuity of service — an unpaid absence or a break between contracts is where most disputes actually start.
When does it have to be paid?
Within 14 days of the end of the relationship. That deadline is missed more often than the calculation is wrong, usually because the leave balance and the last partial month sit in different systems.
Does unpaid leave count towards service?
Generally not, and it is the most common reason a company’s figure and an employee’s figure differ. Check the periods of unpaid absence before you argue about the formula.
